Eric Sanders, Esq., of ¸£Àû¼§., announces former NYPD Police Officer Salvatore J. Greco has filed a federal civil rights lawsuit alleging that he was terminated for supporting Making America Great Again

 

NEW YORK, August 28, 2022 – Today, Greco filed a federal civil rights lawsuit accusing the City of New York; Police Commissioner Keechant L. Sewell; Deputy Commissioner Legal Matters Ernest F. Hart; Lieutenant Daniel S. Cutter and Sergeant Jeremy D. Orenstein of collectively investigating and terminated him due to his personal ‘familial’ and ‘political’ relationships with Roger Jason Stone, Jr., Kristin M. Davis, members of the OATH Keepers, Proud Boys and others who support Trump’s America and the political paradigm of Making America Great Again in violation of the First Amendment – Freedom of Right to Intimate Association and First Amendment – Freedom of Speech.

For more than forty (40) years, Greco accuses the NYPD of intentionally abusing its statutory authority and the internal disciplinary process to discriminate against former NYPD Captain now Mayor Eric L. Adams, former NYPD Sergeant now Sheriff Anthony Miranda, members of the Guardians Association of the Police Department City of New York, Hispanic Society of the Police Department City of New York, and other disenfranchised members of the department because of their race, gender and ‘political’ viewpoints.

As noted in the lawsuit, on or about January 22, 2021, Greco claims the Internal Affairs Bureau Command Center received an anonymous letter as follows: To whom it may concern – I am writing to the NYPD Internal Affairs Bureau about the D.C. take-ver. PO Salvatore Greco CTTF, and PO Gregory Nealon 60 pct., attended the riot at Capitol hill. These officers want to have a civil war in America.

The Internal Affairs Bureau Command Center also received further information including pictures that Greco was ‘associating’ with Roger Jason Stone, Jr., a self-proclaimed “agent provocateur†who has served as strategic counsel to GOP candidates since the 1960s including President Donald J. Trump, the forty-fifth (45) president of the United States and that he was ‘associating’ with Kristin M. Davis, previously known as the Manhattan Madam, accused of operating a high-end prostitution ring catering to high-profile clients.

According to the lawsuit, the Internal Affairs Bureau Command Center opened Log No.: C-2021-0027 and 2021-1610. The ‘C’ designates that the investigation will likely conclude with the filing of criminal charges. Greco claims, the anonymous letter does not suggest he is engaging in criminal activities much less with Roger Jason Stone, Jr., Kristin M. Davis or anyone else, the letter suggests “a civil war with America.†Greco further claims, that the anonymous letter is ‘political’ in nature because of his first amendment right to support Trump’s America and the ‘political’ paradigm of ‘Making America Great Again.’

Greco claims between January 22, 2021, through May 20, 2021, Cutter and Orenstein ‘falsely’ asserted to Hart the need for the City of New York and Sewell to use its administrative subpoena powers under § 14-137(a) of the New York City Administrative Code, to investigate allegations of association narcotics (other than family), DRV – other – due to he allegedly attending the rioting on Capitol Hill, criminal association with Roger Jason Stone, Jr. (Trump advisor), Kristin M. Davis (Manhattan Madam – Prostitution) and OATH Keepers (Anti-government group).

During the investigation, Greco’s cellular telephone, home telephone, social media accounts and other personal records were reviewed and did not support he was involved with criminal or subversive activities to overthrow the United States government.

On or about April 27, 2021, Cutter signed Departmental Charges and Specifications approved by the City of New York and Sewell thorough the Office of the Department Advocate, Department Advocate’s Office Serial No.: 2021 – 23298, accusing him of “wrongfully and knowingly associating with person[s], Roger Jason Stone, Jr., and Kristin M. Davis, reasonably believed to be engaged in, likely to engage in, or to have engaged in criminal activities†along with related department charges.

Greco claims, other than his personal ‘familial’ and ‘political’ relationships with Roger Jason Stone, Jr., and Kristin M. Davis, Cutter and Orenstein were unable to establish any ‘credible’ evidence he was involved in any criminal or subversive activities with them to overthrow the United States government.

Moreover, Greco claims that other than his personal ‘political’ relationships with members of the OATH Keepers, Proud Boys, others who support Trump’s America and the ‘political’ paradigm of ‘Making America Great Again,’ there is no ‘credible’ evidence he was involved in any criminal or subversive activities with them or anyone else to overthrow the United States government.

After a department trial, on or about June 10, 2022, Assistant Deputy Commissioner Paul M. Gamble recommended to the City of New York and Sewell to find Greco guilty of “wrongfully and knowingly associating with person[s], Roger Jason Stone, Jr., and Kristin M. Davis, reasonably believed to be engaged in, likely to engage in, or to have engaged in criminal activities†along with related department charges except “wrongfully and knowingly associated with any person or organization advocating hatred, oppression, or prejudice based on race, religion, gender, gender identity/expression, sexual orientation, or disability.†Gamble recommended Greco be separated from the department because “Under the circumstances established in the trial record, Respondent’s [Plaintiff SALVATORE J. GRECO] continued presence as a Member of the Service would be corrosive to the mission and values of this Department.â€

On or about August 4, 2022, the City of New York and Sewell adopted Gamble’s recommendation and dismissed Greco under § 14-115(a) of the New York City Administrative Code.

“The action taken against me has cost me my reputation, my job, and my life savings,” Greco said.

“Unfortunately, Mr. Greco’s case is not unusual in that the department have been engaging in these sorts of ‘political viewpoint’ hit jobs for more than forty (40) years. With these legal claims, Mr. Greco intends to shed light on the institutional problem and hold the City and the other defendants’ accountable for these actions,†said lawyer .

Eric Sanders, Esq., of ¸£Àû¼§., announces the filing of a lawsuit filed against the City of New York and Bronx District Attorney Darcel D. Clark. Crime Analyst Crystal Rivera alleges she suffered mental anguish, pain, and suffering when Clark and her staff retaliated against her for failing to cooperate with a baseless racially charged criminal investigation against NYPD Detective David Terrell

New York, NY, January 19, 2019 – Ms. Rivera claims, almost 11 years ago, she was appointed to the Office of the Bronx District Attorney.

According to the lawsuit, since her appointment, the Office of the Bronx District Attorney is rife with employees engaging in utter incompetence, serious misconduct and unethical practices directly impacting primarily complainants and defendants’ constitutional rights.

Instead of investigating and prosecuting crimes, Ms. Rivera alleges prosecutors and other employees routinely shop, consume alcohol in the office, engage in sexual activities in the office and other improper activities, according to the lawsuit.

Ms. Rivera claims, its prosecutors routinely “judge shop†meaning bring questionable legal documents such as search warrants to be endorsed by the Court although there is no matter pending before that Court.

Several years ago, Ms. Rivera claims she began a personal relationship with NYPD Detective David Terrell (African-American Male) of the 42nd Precinct.

According to the lawsuit, more than two years ago, Bronx District Attorney Darcel D. Clark (African-American Female) and Chief of the Homicide Bureau Christina Scaccia (Caucasian Female) assigned Assistant District Attorney David Slott (Caucasian Male) to handle the criminal cases against Pedro Hernandez and the rest of The Hill Top Crew.

During the investigation, Ms. Rivera met with Deputy Chief of the Strategic Enforcement/Intergovernmental Relations Division Carmen J. Facciolo III (Caucasian Male). Prior to meeting with Deputy Chief Facciolo III, she received information from another colleague that the private investigator from the Pedro Hernandez case, private investigator Manny Gomez have a personal relationship with an employee Michelle Rayo (Caucasian Female) and has been seen throughout several secure areas of the office.

According to the lawsuit, Ms. Rivera later met with Chief of the Trial Division Jeremy Shockett (Caucasian Male); Deputy Chief Facciolo III; Deputy Chief of the Narcotics/Gang Bureau Terry H. Gensler (Caucasian Female); Bureau Chief Scaccia and Assistant District Attorney Slott. Ms Rivera claims that they were collectively unaware of crucial evidence collected against Pedro Hernandez and the rest of The Hill Top Crew, this is consistent with the incompetent and unethical practices of the office.

Ms. Rivera claims, Bronx District Attorney Clark using her staff decided she would be used to ‘publicly vilify’ NYPD Detective Terrell with allegations of a baseless criminal investigation against him. After rebuffing Bronx District Attorney Clark’s and her staff’s tactics, they began to target her for a baseless criminal investigation.

Deputy Chief Gensler then proceeds to talk about NYPD Detective Terrell, Sergeant Andrew Uruci, and the 42 whole Pct. is going down. According to the lawsuit, Deputy Chief Gensler said, “David Terrell is a fucking crooked cop and that is typical because he’s Black and Sergeant Uruci is a moron for not controlling Terrell.†Ms. Rivera claims, that’s not the first time she has heard Deputy Chief Gensler and other members of Bronx District Attorney Clark’s staff referring to persons of color in a negative light.

Ms. Rivera claims, Chief of the Public Integrity Bureau Wanda Perez-Maldonado (Latina Female) even implied she had a personal relationship with Pedro Hernandez and The Hill Top Crew. After the intense questioning quickly shifted to her personal relationship with NYPD Detective Terrell but, she ignored the questions related her personal life.

In late August, she met with Bureau Chief Perez-Maldonado and Detective Investigator Terrence Mulderrig (Caucasian Male) in her office. Shortly thereafter, Ms. Rivera noticed a notepad with her name written on it along with her cellphone and financial records. Bureau Chief Perez-Maldonado told her, she lied and needs a lawyer.

A few days later, Bureau Chief Perez-Maldonado asked Ms. Rivera if any employees knew about her personal relationship with NYPD Detective Terrell. Shortly thereafter, Deputy Chief Administrative Chief Human Resources/Labor Relations Arthur B. Simmons told Ms. Rivera effective immediately, she is being suspended with pay pending the outcome of the criminal investigation.

On September 6, 2017, Bronx District Attorney Clark dismissed the case against Pedro Hernandez.

According to the lawsuit, in an elaborate ruse to perpetuate a fraud upon the public to cover up the incompetence, serious misconduct and unethical practices of the Office of the Bronx District Attorney, Clark falsely claimed to have started an investigation into the law enforcement practices of the 42nd Precinct. Bronx District Attorney Clark, falsely published a press release claiming her Public Integrity Bureau “delved into the allegations surrounding the Pedro Hernandez case.â€

On January 19, 2018, Bronx District Attorney Clark charged Ms. Rivera with misconduct related to her personal relationship with NYPD Detective Terrell but, did not serve her.

On January 22, 2018, Bronx District Attorney Clark suspended her without pay.

On February 23, 2018, Bronx District Attorney Clark sent two detective investigators to her former mother in law’s home threatening to “pick her up.†Later that day, the same two detective investigators served her with administrative charges related to her personal relationship with NYPD Detective Terrell.

On May 8, 2018, after an Informal Hearing, Hearing Officer Nicole Keary sustained charges related to her personal relationship with NYPD Detective Terrell but, DID NOT rule on the validity of any directive against contact with him. Ms. Rivera claims that Hearing Officer Keary recommended time credited while under suspension without pay, a demotion via reassignment to duties with reduced access to sensitive information.

On June 4, 2018, Ms. Rivera declined the recommendation and informed Bronx District Attorney Clark that “Unfortunately, after review, Ms. Rivera vehemently disagrees with the findings and recommendations; therefore, elects to proceed to Step II. In the meantime, Ms. Rivera expects to be immediately reinstated with all backpay and benefits consistent with Civil Service Law Section 75 and transferred to another unit pending the outcome of this disciplinary matter. Thank you.â€

Shortly thereafter, Bronx District Attorney Clark reinstated her with all backpay and benefits consistent with Civil Service Law Section 75, but, never scheduled her for a Step II Hearing. 

On July 2, 2018, Bronx District Attorney Clark transferred her to the Crime Victims Assistance Unit, Satellite Office.

Almost immediately, Ms. Rivera claims Mr. Brian Wareham began subjecting her to unwanted physical contact including unsolicited hugs, grabbing her hand, touching her arm and buttocks. On October 1, 2018, she wrote an email to Director, Crime Victims Assistance Unit Beth Ann Holzhay and Supervising Coordinator Priscilla Taveras about Mr. Wareham’s conduct and his constant interference with her work assignments. Ms. Rivera alleges neither filed a complaint on her behalf because of her publicly filed complaints alleging public corruption against the Office of the Bronx District Attorney and her personal relationship with NYPD Detective Terrell.

“The Bronx DA’S Office is retaliating against me for exercising my First Amendment right of freedom of association; for re-buffing the incompetence, serious misconduct and unethical practices of the office and for failing to cooperate with a baseless racially charged criminal investigation against David,†says Ms. Rivera.

“Under DA Clark, ‘let the constitution be damned.’ With the filing of this lawsuit, we intend to hold Bronx District Attorney Clark and her staff legally accountable for their disgraceful conduct, says Eric Sanders.

Shortly thereafter, Deputy Chief Administrative Chief Human Resources/Labor Relations Arthur B. Simmons told Ms. Rivera effective immediately, she is being suspended with pay pending the outcome of the criminal investigation.

On September 6, 2017, Bronx District Attorney Clark dismissed the case against Pedro Hernandez.

According to the claim, in an elaborate ruse to perpetuate a fraud upon the public to cover up the incompetence, serious misconduct and unethical practices of the Office of the Bronx District Attorney, Clark falsely claimed to have started an investigation into the law enforcement practices of the 42nd Precinct. Bronx District Attorney Clark, falsely published a press release claiming her Public Integrity Bureau “delved into the allegations surrounding the Pedro Hernandez case.â€

On January 19, 2018, Bronx District Attorney Clark charged Ms. Rivera with misconduct related to her personal relationship with NYPD Detective Terrell but, did not serve her.

On January 22, 2018, Bronx District Attorney Clark suspended her without pay.

On February 23, 2018, Bronx District Attorney Clark sent two detective investigators to her former mother in law’s home threatening to “pick her up.†Later that day, the same two detective investigators served her with administrative charges related to her personal relationship with NYPD Detective Terrell.

“The Bronx DA’S Office is retaliating against me for exercising my First Amendment right of freedom of association; for re-buffing the incompetence, serious misconduct and unethical practices of the office and for failing to cooperate with a baseless racially charged criminal investigation against David,†says Ms. Rivera.

“Under DA Clark, ‘let the constitution be damned.’ With the filing of this claim, we intend to hold Bronx District Attorney Clark and her staff legally accountable for their disgraceful conduct, says Eric Sanders.

NEW YORK, May 1, 2017 – New York Civil Rights Attorney Eric Sanders, Esq., of ¸£Àû¼§., representing NYPD Police Officer Michele Hernandez sues for $35 Mil in a newly filed amended federal lawsuit alleging the Bronx DA is retaliating against her for exposing public corruption

According to the amended federal lawsuit, NYPD Police Officer Michele Hernandez alleges from March 2003 through present while assigned to various NYPD precincts within Bronx County, she and other similarly situated police officers are being forced to follow the ticket and arrest quota systems aka performance goals in violation of their constitutional rights which are implemented to illegally tax constituents, raising revenues, advancing the political agendas of government officials and Department executive management who are rewarded with overtime, compensatory time, promotions and other job benefits for enforcing the ticket and arrest quota systems.

Ms. Hernandez further alleges the ticket and quota systems aka performance goals disparately impact African-American, Hispanics and other persons of color who travel through, work and reside in Bronx County.

Despite the so-called high-profile ‘Ticket-Fixing’ Scandal allegedly investigated by the NYPD Internal Affairs Bureau and the Bronx County District Attorney’s Office, the practice of ‘fixing’ tickets still continues to this date, according to the lawsuit. The so-called investigation primarily focused upon police officers, sergeants and lieutenants. They were subjected to arrest, suspensions and terminations. Meanwhile, Ms. Hernandez alleges, executive management (Captains and above) were largely absolved although the ‘fixing’ couldn’t have occurred without their ‘explicit’ approval.

Ms. Hernandez alleges on March 11, 2014, she initiated a legal car stop of New York City Councilwoman Vanessa L. Gibson in Bronx County who she observed talking on her cellular telephone without a hands free device. While stopped, she asked NYC Councilwoman Gibson if the ‘CO’ was on the cellular telephone. NYC Councilwoman Gibson handed her the cellular telephone, former commanding officer Kevin Catalina then begged her, “Please don’t write the summons because she meets with the Mayor and Police Commissioner monthly in her role with the Public Safety Committee.†NYC Councilwoman Gibson was immediately released and the summons wasn’t issued. The next day, Summons No.: AAW9075382 was ‘VOIDED’ by the Training Sergeant. The ‘VOIDED’ summons was endorsed by Catalina and sent through channels. Unbeknownst to them, Ms. Hernandez kept a copy of the summons because she knew it was wrong but, she had nowhere to file her complaint.

Several months later, Ms. Hernandez was transferred to the 49th Precinct and eventually under commanding officer Keith Walton where she was warned by other supervisors and police officers that no one wants to work with her. Prior to her transfer, she was accused of being a ‘rat’ by Lieutenant Wilson, 44th Precinct, according to the lawsuit.

Ms. Hernandez alleges 49th Precinct personnel engages in the same sort of ticket and arrest quota systems along with ‘fixing.’ Under commanding officer Keith Walton, Ms. Hernandez alleges she’s still being subjected to unfair assignments and discipline for ‘passively’ rejecting the ticket and arrest quota systems. Since Ms. Hernandez’s transfer into the 49th Precinct, on numerous occasions her vehicle has been damaged. Ms. Hernandez alleges she and other similarly situated police officers are afraid to report these acts of corruption because other police officers who have complained have been subjected to suspensions, transfers and terminations.

After Ms. Hernandez filed her federal lawsuit several months ago, she now alleges as a favor to her friend NYC Councilwoman Gibson, Chairperson of the Public Safety Committee who have jurisdiction and budget control over the Office of the Bronx District Attorney, Bronx DA Darcel D. Clark opened a criminal inquiry against her through the Public Integrity Bureau. The ‘criminal inquiry’  involves Hernandez’s interactions with NYC Councilwoman Gibson and the surrounding circumstances of the summons VOID.

Ms. Hernandez alleges Bronx DA Clark; Chief of the Public Integrity Bureau Wanda Perez-Maldonado; Deputy Chief of the Public Integrity Bureau Omer Wiczyk and Special Assistant District Attorney Katherine J. Hwang knows this ‘criminal inquiry’ is retaliatory, legally and ethically wrong, not in the ‘public interest’ but proceeded anyway.

“This so-called investigation is in retaliation for Police Officer Hernandez expressing her First Amendment right to expose public corruption involving these parties,†says Eric Sanders.

Ms. Hernandez filed her $35 Million Dollar amended federal lawsuit in the United States District Court for the Southern District of New York, Docket No.: 16 cv 9226 on April 28, 2017.

Richter, their members, other members of the law enforcement community, and other stakeholders, consisting of primarily Caucasian Males who were publicly very critical of his police reform lobbying efforts.

Prior to retirement, Pegues began creating his memoir for publication believing his life experiences might have a positive impact upon others.

On August 13, 2014, consistent with his other public lobbying efforts, he appeared on The Combat Jack Show. The show titled The Corey ‘Life’ Pegues – “From the Streets to the Beat.â€

On the show, Pegues discussed his childhood along with the “political†controversies involving Abner Louima, Sean Bell, Eric Garner and Oscar Grant. He publicly called Eric Garner’s death, a murder.

On September 8, 2014, the New York Post featured Pegues on its front page as a “Thug Cop.†Pegues accuses The New York Post of “intentionally†misleading readers into believing he committed criminal acts as a police officer, misrepresenting his interview on The Combat Jack Show as well as the basis for the receipt of his Line of Duty Accidental Disability Retirement Pension to generate newspaper and advertising revenue at the expense of his reputation in the community.

Later that evening, Nassau County Acting Police Commissioner Thomas C. Krumpter as a “political favor†to NYPD Police Commissioner William J. Bratton sent officers to Pegues’s home and seized his firearms although he violated no conditions of the “FULL UNRESTRICTED†Concealed Carry Law Enforcement Pistol License issued to him.

On December 6, 2014, Police Commissioner William J. Bratton and Deputy Commissioner, Internal Affairs Joseph J. Reznick sent Pegues an undated letter in essence “revoking†his “Good-Guy†Status demanding the return of his police department identification card referencing the September 8, 2014, New York Post article.

In short, Pegues alleges Police Commissioner William J. Bratton, Deputy Commissioner, Internal Affairs Joseph J. Reznick, Nassau County Acting Police Commissioner Thomas C. Krumpter and the New York Post violated his First Amendment Right to Freedom of Speech discussing police reforms, in particular, calling Eric Garner’s death a murder. In retaliation, they collectively violated his civil rights by “intentionally†suspending his pistol license, “revoking†his police identification and damaging his reputation in the community.

“In their political haste, they apparently forgot Mr. Pegues have legal rights. The facts, unfortunately for them, Mr. Pegues served honorably with the United States Army and the NYPD for more than 20 years. People of color and other disenfranchised citizens all over the nation are under siege from over-militarized aggressive police forces resulting in serious violations of their civil rights. Despite these Ad Hominem attacks, Mr. Pegues will continue sharing his personal journey and publicly lobbying for police reform.†Eric Sanders says.
