Two female NYPD officers’ disciplined for tossing football with a young boy while on their post were found ‘Not Guilty’ of misconduct by the Trial Commissioner after a Department Trial. The decision was approved on December 17, 2012, by Police Commissioner Raymond W. Kelly. “This was yet another colossal waste of Department Resources” says Eric Sanders.
“The Department really needs to rethink its definition of community policing. I think the Department prefers its officers to be an occupying force rather than positively interacting with the community it serves” Sanders said.

Two cops hailed as heroes and then brought up on departmental charges after a fatal shooting in Brooklyn could soon be in the clear.

lawyers have told an administrative judge that charges should be dropped against Officers India Archie and Dawn Ortiz. Commissioner Raymond Kelly has the final say on whether the officers get disciplined.

Archie’s lawyer Eric Sanders said she was still upset over being charged.

“She believes the department should not have charged her for failing to communicate with Ortiz. It wouldn’t have changed the outcome,” Sanders said.

At 10 a.m. Tuesday, the fatal shooting of a day laborer by Officer Dawn Ortiz of the New York City police more than two years ago endured some of its final public moments in a quiet courtroom at Police Headquarters. Now, the departmental lawyer said the circumstances had been reviewed. And she said she was moving to dismiss the internal charges against Officer Ortiz, recommending instead that she receive retraining on the nature of such encounters.

Eric Sanders, a lawyer for Officer Archie, said that in the internal trial against her, a conference had been scheduled for Friday.

“They are talking about dismissing, but I won’t know until Friday what they really want to do because it seems that they are changing their position,” Mr. Sanders said. “The policy was on the officers’ side the entire time, as is the law, and this is a waste of time and money.”

A former narcotics detective called a “nappy-headed ho” by her sergeant will receive $130,000 from the city to settle her federal suit.

The sergeant, Michael Cantatore, will also have to cough up $1,500 of his own money to pay retired Detective Aretha Williams.
Cantatore retired from the force before any disciplinary action was taken against him; Williams retired in 2009.
“She feels Cantatore was never punished for his behavior,” said Williams’ lawyer, Eric Sanders.

Two cops honored after the fatal shooting of a crazed man who was waving a metal chair have been slapped with disciplinary charges in the incident.

Officers Dawn Ortiz and India Archie were each commended as “Cop of the Year” by the Holy Name Society – at a ceremony Police Commissioner Raymond Kelly attended.

Kelly even posed for pictures with the proud cops and Brooklyn Bishop Nicholas DiMarzio.

Now they face a department trial for failing to first use a baton or pepper spray before Ortiz fired the single shot that killed Gilberto Blanco, a 45-year-old emotionally disturbed man.

“I am confident that the police commissioner will immediately resolve this apparent conflict within the department’s original position,” Archie’s lawyer Eric Sanders said.
